Inmate files lawsuit over lack of timely medical care

Hagatna — A Guan inmate says the Department of Corrections violated his Eighth Amendment rights when officers failed to provide him with medical care, AP reports. The Pacific Daily News reports (http://bit.ly/1dL0qFO ) the lawsuit filed in the District Court of Guam seeks $25,000 for emotional stress and another $25,000 in punitive damages. Inmate Francisco Arias filed the lawsuit Friday saying his toe is disfigured from a bone fracture that was left untreated for too long, and his diabetes and blood pressure medications still aren’t being filled in a timely manner.

The prison was ordered by a judge in January to fix ongoing problems with its medical, mental and dental health care issues. Arias has another lawsuit pending against the DOC, asking for $1,400 in damages for mail Arias says was thrown away.
